This insurance program has been specifically designed to meet the unique needs of a U.S. based sports instructor directly supervising an individual or a group engaged in sports-related skills.


IMPORTANT PROGRAM CHANGE: As of 3/1/20, covered operations under this program now includes virtual training/instruction under your direct supervision or organized by you (you = the named insured on the policy).  The intent of this wording is to provide coverage for operations that involve live online streaming/real-time instruction with your clients/members via the internet. The instructor should be able to communicate visually and verbally with the participants at all times during instruction.  Recorded training sessions of covered sports/activities are also approved provided that ONLY your registered members/clients have access.  
      

We expect that all reasonable precautions will still be taken when you are assessing potential new clients online, including but not limited to: health assessments, waivers/release forms, and interviews with clients prior to instruction or training. We encourage our clients to consult with their attorney to consider special waiver/release agreements that will apply specifically to online streaming/real-time instruction. 

Please note, virtual training/instruction does not extend to any training/instruction that includes gymnastic apparatuses, tumbling, or stunting (including pyramids), or in-water activities.  The policy is not intended to extend to online streaming/real-time instruction or recorded videos/sessions that are accessible by the general public/non-members.  We do not provide coverage for cyber liability, so if you are taking payment or collecting personal information online and it is compromised, there would be no coverage under the general liability policy.

 
Eligible Operations

A U.S.-based instructor age 18 or older conducting private or group instruction in any of the following:

 

- Baseball - Lacrosse
- Basketball - Racquetball
- Baton twirling - Road running
- Bowling - Soccer
- Cheerleading - Softball
- Cross country - Swimming
- Dance** - Table tennis
- Fencing - Tennis
- Figure skating - Track & field
- Football - Tumbling (floor only, no gymnastic apparatus)
- Golf - Volleyball
- Hockey - Wrestling

Ineligible for this program:

Certain operations are not eligible for coverage by this program. K&K reserves the right to decline any request for coverage. The ineligible operations include, but are not limited to the following (and are excluded from coverage):

- Certified athletic trainers - Instructors under the age of 18
- Coaching of organized competitive athletic teams - Instructor's employment as an exempt or a non-exempt
         employee of a school, university or college
                 
Instruction of the following activities:  
- Canoeing - Lifeguarding
- Cycling - Martial arts
- Diving - Rowing
- Equestrian - Scuba diving
- Gymnastics - Skiing
- Kayaking - Surfing

Liability Coverage
 
   

General liability coverage protects you if you are legally obligated to pay damages for bodily injury to others and for damage to the property of others resulting from your sports-related skills instruction. The policy also provides coverage (professional liability) for wrongful acts (breach of duty, neglect, error, omission, misstatement or a misleading statement in the discharge of sports-related skills instruction) that occur as a result of your instruction.

- Bodily Injury & Property Damage - Professional Liability
- Products-completed Operations - Damage to Premise Rented to You
- Personal and Advertising Injury - Medical Expense (Other than participants)
- Legal Liability to Participants    
 

Exclusions

 
- Abuse, molestation, harassment, or sexual conduct - Operation, ownership or management of a commercial
- Amusement devices (e.g.: rides, slides, inflatables, sports facility
bungees, climbing walls, dunk tanks) - Physicals/stress testing
​-Communicable Diseases (effective 7/1/20 and after)​-​Physical therapy, massage or salon services
​-​Cryogenic chambers/therapy​-​Sale or distribution of herbal, medicinal
- ​Cycling (other than stationary) and/or nutritional products
- Employment-related practices - Those operations listed as ineligible
- Instruction/activities being held on or in open water - Violation of statutes that govern e-mails, faxes, phone call
- (e.g.: lakes, ponds, ocean) or other methods of sending materials or information.
